SCARNATTI™ – 10-Year Commercial Guarantee of Durability for Mattresses

At Scarnatti, we place great importance on long-term product quality, durability and reliable performance. For this reason, RENABED EUROPE BV provides a 10-year commercial guarantee of durability covering the entire mattress for new Scarnatti® mattresses, subject to the terms below.

This guarantee applies in addition to the consumer's statutory rights and does not restrict those rights.

RENABED EUROPE BV is the guarantor of this commercial guarantee of durability.

2. Statutory Rights of the Consumer

Consumers have statutory rights against the seller in the event of defects. Exercising these statutory rights is free of charge.

These statutory rights are neither restricted nor replaced by this commercial guarantee of durability. This guarantee applies in addition to the consumer's statutory rights in relation to defects.

3. Territorial Scope

This guarantee applies to Scarnatti® mattresses delivered by Scarnatti or an authorised reseller to consumers in the Netherlands.

Separate guarantee terms adapted to the applicable national law may apply to deliveries to other countries.

4. Products Covered by the Guarantee

This guarantee applies to new Scarnatti® mattresses purchased directly from Scarnatti or from an authorised reseller.

Display models, demonstration products or products obtained through unauthorised sales channels are covered only where this has been expressly confirmed for the product concerned.

The commercial guarantee is granted to the original purchaser in accordance with these warranty terms.

Guarantee services may be carried out by RENABED EUROPE BV itself or by retailers, logistics partners or service partners appointed by RENABED EUROPE BV or Scarnatti.

5. Duration of the Commercial Guarantee of Durability

The commercial guarantee of durability applies for ten (10) years from the date of delivery of the mattress.

It covers the entire mattress, including in particular:

• the mattress core,
• the structural foam layers,
• the mattress cover,
• its structural components, including the zipper.

The exclusions described below for normal cosmetic wear, improper use, failure to follow care and use instructions, and damage caused by external factors remain unaffected.

6. EU GARAN Label

The harmonised EU GARAN label with a duration of 10 years is used for this 10-year commercial guarantee of durability.

RENABED EUROPE BV thereby guarantees that the complete Scarnatti® mattress will retain its required functions and intended performance during the guarantee period under normal use and use for its intended purpose.

If a case covered by this guarantee arises, a remedy will be provided free of charge by repair or replacement.

The separately regulated supplementary guarantee for the mattress core in years 11 to 13 is not part of the 10-year guarantee of durability identified by the EU GARAN label.

7. Scope of the 10-Year Guarantee of Durability

RENABED EUROPE BV guarantees that, under normal use, use for its intended purpose and proper care, the Scarnatti® mattress will retain its required functions and intended performance throughout the guarantee period.

The guarantee covers in particular:

• material defects,
• manufacturing defects,
• workmanship defects,
• structural defects,
• other adverse changes or physical defects that materially impair the intended usability, required function or intended performance of the mattress.

For a valid guarantee claim, the guarantee service will be provided free of charge.

This also includes the costs necessary for the guarantee service, including inspection, collection or return transport, materials, labour, repair, replacement and redelivery.

8. Cases Specifically Covered by the Guarantee

Permanent Indentations and Deformations

A permanently visible indentation in the mattress core of more than 3 cm after the mattress has been fully unloaded, provided that an actual permanent deformation exists and that it is not merely a normal adjustment of the cover or surface materials.

An indentation of less than 3 cm is not automatically excluded from the guarantee solely because of its depth if it is associated with a material impairment of the intended usability, function or performance.

Adverse Changes and Physical Defects

Adverse changes or physical defects that materially impair the intended usability of the mattress are also covered, provided that they occur during normal use and use for the intended purpose and are not attributable to an exclusion set out in these warranty terms.

This may include, in particular, structural deformation, material failure, tears, splits or comparable physical defects.

Mattress Core and Structural Components

Material, manufacturing and workmanship defects affecting the mattress core or other structural components are covered.

Mattress Cover and Zipper

The mattress cover forms part of the complete mattress and is therefore, in principle, included in the 10-year guarantee of durability.

The guarantee covers in particular:

• demonstrable material defects,
• manufacturing defects,
• workmanship defects,
• manufacturing or material defects affecting the zipper and its attachment,
• functional defects that cause the cover to lose its required function during normal use and use for its intended purpose.

Normal textile wear and normal signs of use affecting the zipper do not, solely by their occurrence, constitute a guarantee case, provided that they do not impair the required function or performance of the product.

9. Normal Wear and Tear – in Particular the Cover and Zipper

The 10-year guarantee of durability does not mean that the mattress, cover or zipper must remain visually as new throughout the entire guarantee period.

The following normal signs of use that do not affect function are not, in particular, considered a guarantee case:

• normal pilling,
• minor discolouration,
• superficial textile abrasion,
• minor creasing,
• normal changes to the surface structure,
• normal stretching of the textile,
• visual changes to the zipper,
• normal mechanical signs of use on the zipper and cover,
• other cosmetic changes that do not impair the required function or performance.

With regard to the cover and zipper, material, manufacturing and workmanship defects are covered in particular.

Mere cosmetic wear caused by age and use does not give rise to a guarantee claim.

However, if a change occurring during normal use results in an actual loss of a required function or performance of the complete mattress, it will be assessed whether a guarantee case exists within the meaning of this guarantee of durability.

10. Washing, Care and Use Instructions

The mattress cover may only be cleaned and used in accordance with the washing, care and use instructions applicable to the relevant product.

Damage is not covered by the guarantee to the extent that it was caused by failure to comply with these washing, care or use instructions.

This includes, in particular, damage caused by:

• an incorrect washing temperature,
• unsuitable detergents or cleaning agents,
• unauthorised drying methods,
• excessive mechanical stress,
• improper opening or closing of the zipper,
• improper removal or refitting of the cover,
• other treatment that deviates from the communicated care and use instructions.

A deviation from a care or use instruction does not automatically result in the loss of all guarantee rights. The exclusion applies only to the extent that the deviation caused the claimed damage or materially contributed to its occurrence.

11. General Exclusion for Improper Use

Damage is not covered by this guarantee to the extent that it was caused by improper use, use other than for the intended purpose, or misuse.

This includes in particular:

• using the mattress for a purpose other than its intended purpose as a sleeping surface,
• exceptional mechanical stress,
• jumping on the mattress,
• improperly folding or sharply bending the mattress,
• use or storage under unsuitable climatic conditions,
• intentional damage,
• serious neglect,
• unauthorised modifications to the product,
• damage caused by improper repair attempts,
• other use that clearly deviates from the intended normal household use.

Improper use of an individual component does not automatically result in the loss of the guarantee for other defects that are unrelated to that use.

12. Other Damage Not Covered by the Guarantee

The following are not covered by the guarantee in particular, to the extent that the relevant causal connection exists:

• mere changes in personal comfort preferences,
• purely subjective perceptions of different softness or firmness where there is no objective defect,
• damage caused by excessive exposure to sunlight or UV radiation,
• normal dimensional tolerances of up to 3 cm, provided that function and intended use are not impaired,
• stains,
• burn marks,
• cuts, punctures or other external damage,
• damage caused by liquids or bodily fluids,
• contamination caused by humans or animals,
• pest infestation,
• weather-related damage,
• damage resulting from unsuitable storage,
• mould or fungal growth to the extent caused by moisture, insufficient ventilation, contamination or other external factors.

13. Requirements for the Bed Base and Frame

The mattress must be used on a sufficiently stable, level and evenly supportive surface.

Suitable bases include in particular:

• high-quality slatted bases with gaps of less than 4 cm between the slats,
• suitable box-spring bases providing even support across the entire surface,
• stable platforms or bases providing homogeneous and sufficiently continuous support.

Large gaps between slats may cause individual areas of the mattress core to receive insufficient support, which can lead over time to increased material stress or premature deformation.

For wide bed frames, a centre support must not create a significantly different height or localised variation in support that causes the mattress to be loaded unevenly.

Damage is excluded from the guarantee to the extent that it can be shown to have been caused by an unsuitable, unstable, uneven or insufficiently supportive base.

The general exclusion for improper use or use other than for the intended purpose under Section 11 also applies.

Use of an unsuitable base does not automatically result in the loss of guarantee rights in respect of defects that are unrelated to the base.

14. Guarantee Assessment

For a proper assessment, it may be necessary to inspect the complete mattress, including its corresponding mattress cover.

Therefore, do not remove or dispose of the cover in connection with a guarantee assessment unless Scarnatti expressly asks you to do so.

15. Making a Guarantee Claim

Guarantee claims may be submitted directly to Scarnatti or RENABED EUROPE BV via the warranty or contact form provided on the Scarnatti website.

If the mattress was purchased from an authorised retailer, the consumer may also submit the claim through that retailer. The right to contact RENABED EUROPE BV directly under this guarantee remains unaffected.

For a prompt and proper assessment, the following information and documents may in particular be requested:

• proof of purchase or delivery, such as an invoice or Scarnatti order number,
• a description of the claimed damage or defect, including, where known, the time and circumstances in which it arose,
• photos or videos of the claimed damage,
• photos or videos showing the general condition of the mattress,
• where relevant to assessing the specific damage, photos of the bed frame or support system used.

Further information may be requested to the extent reasonably necessary to assess the nature, cause and extent of the claimed guarantee case.

Requesting such information is solely for the purpose of technical assessment and does not alter the statutory allocation of the burden of proof.

16. Repair or Replacement

If a valid guarantee case exists, a remedy will be provided free of charge by repair or replacement in accordance with these warranty terms and the applicable legal provisions.

If the model originally purchased is no longer available, a technically and qualitatively equivalent replacement product may be provided.

Due to technical developments, a replacement product may differ slightly from the original product in terms of colour, material, construction or feel.

The transport, travel, labour and material costs necessary for a valid guarantee service will be borne by RENABED EUROPE BV.

Repair or replacement does not, in principle, restart the original 10-year guarantee period unless mandatory law provides otherwise.

A replacement under the guarantee does not create a new sleep trial period.

17. Voluntary Upgrade in the Event of Replacement

In the event of an accepted guarantee claim, the consumer may, if this option is offered, choose a higher-value model or a larger size instead of an equivalent replacement product.

The regular equivalent guarantee remedy remains free of charge.

If the consumer voluntarily chooses an upgrade, only the additional price arising from the higher-value model or larger size, as transparently communicated in advance, may be charged.

Supplementary Guarantee for the Mattress Core in Years 11 to 13

18. Nature of the Supplementary Guarantee

In addition to the 10-year commercial guarantee of durability, the original purchaser may activate a supplementary commercial guarantee for the mattress core for years 11 to 13 by registering free of charge using the warranty form provided by Scarnatti.

Registration deadline: within 30 days after delivery

The supplementary guarantee is a separate guarantee with its own scope of coverage.

It:

• does not extend the 10-year guarantee of durability identified by the EU GARAN label,
• does not constitute a 13-year guarantee of durability for the complete mattress,
• does not form part of the guarantee duration stated on the EU GARAN label.

The EU GARAN label therefore continues to state a duration of 10 years.

19. Scope of the Supplementary Guarantee

The supplementary guarantee for years 11 to 13 covers only certain defects affecting the mattress core, in particular:

• material defects,
• manufacturing defects,
• structural defects,
• permanent structural changes that materially impair the intended usability of the mattress core.

The supplementary guarantee does not cover in particular:

• the mattress cover,
• the zipper,
• textile components,
• normal wear and tear,
• cosmetic changes,
• normal changes in feel,
• changes in personal comfort preferences,
• damage caused by unsuitable bases,
• damage resulting from improper use or use other than for the intended purpose,
• damage resulting from failure to follow care or use instructions,
• damage caused by moisture, liquids, contamination or other external factors.

20. Remedies Under the Supplementary Guarantee

For a valid claim under the supplementary guarantee, the affected mattress core or, where technically necessary, the mattress will be repaired or replaced with an equivalent product.

The standard guarantee remedy will be provided without additional cost to the consumer for an accepted guarantee claim.

The necessary standard costs of repair, replacement and the transport required for this purpose will be borne by RENABED EUROPE BV.

21. Duration of the Supplementary Guarantee

The supplementary guarantee begins immediately after expiry of the 10-year commercial guarantee of durability and ends at the expiry of the 13th year after the original delivery date.

Repair or replacement under this supplementary guarantee does not, in principle, restart or extend the guarantee period unless mandatory law provides otherwise.

22. Final Provisions

These warranty terms do not restrict any mandatory statutory rights of the consumer.

If any individual provision of these warranty terms is or becomes wholly or partially invalid, the consumer's mandatory statutory rights and the remaining warranty terms remain unaffected.
