10-Year Commercial Durability Guarantee and Additional Mattress Core Guarantee for Years 11 to 13

RENABED EUROPE BV provides, for new Scarnatti® mattresses and subject to these terms, a 10-year commercial durability guarantee covering the entire mattress.

This guarantee is provided in addition to the consumer's statutory rights and does not limit those rights.

The guarantee period stated on the EU GARAN label is 10 years and covers the entire mattress throughout that period.

The additional guarantee offered for years 11 to 13 is a separate commercial guarantee that covers only the mattress core and must be activated separately. This additional guarantee does not constitute a 13-year guarantee for the entire mattress and does not extend the 10-year GARAN period.

This guarantee applies to new Scarnatti® mattresses sold as new by Scarnatti or by an authorised Scarnatti sales channel at the time of purchase and delivered to consumers within the European Union.

The guarantee is provided for normal private household use.

2. Statutory Rights and Guarantee Period

The consumer's statutory rights against the seller in relation to defective or non-conforming goods are free of charge and are entirely independent of this commercial guarantee.

This guarantee does not replace or limit those statutory rights.

The 10-year commercial durability guarantee begins on the date the mattress is first delivered and ends 10 years after that date.

Repair, replacement of a component or delivery of a replacement product does not start a new guarantee period or a new 101-Night Trial Period.

3. Scope of the Initial 10-Year Guarantee

The initial 10-year commercial durability guarantee covers the entire mattress.

This includes in particular the mattress core, structural foam layers, mattress cover, zipper and other structural components required for the intended use of the mattress.

RENABED EUROPE BV guarantees that, under normal use, use in accordance with its intended purpose and appropriate care, the mattress will retain the essential functions and structural performance required for its intended use throughout the guarantee period.

The guarantee does not mean that the mattress will remain exactly as it was on the first day throughout the guarantee period in terms of appearance, surface feel, colour, perceived firmness or personal comfort.

4. Conditions Covered by the Guarantee

Material, manufacturing, workmanship and structural defects that arise during normal and intended use and materially affect the required functions of the mattress or its suitability for its intended use are covered by the guarantee.

This also includes abnormal breakage, separation or loss of structural integrity in the mattress core or structural foam layers, as well as a material loss of the required function of the cover or zipper due to a material, manufacturing or workmanship defect.

Not every visible, perceptible or aesthetic change constitutes a guarantee case on its own.

For the purposes of the guarantee, the decisive factor is whether there is an objectively identifiable impairment of a required function of the product or of its structural usability.

5. Permanent Indentation and Material Changes

A permanent actual indentation of more than 3 cm in the mattress core arising during normal and intended use will in principle be treated as covered by the guarantee, provided that it is not caused by an exclusion stated in these terms.

Normal adjustment or wrinkling of the cover, quilted surface or surface materials does not by itself constitute deformation of the core.

A change of 3 cm or less is not automatically excluded from the guarantee. It will be assessed separately where there is also an objectively identifiable material structural or functional loss.

Normal foam softening, material settling, recoverable body impressions, colour changes and similar natural material changes resulting from normal use are not covered by the guarantee where they do not materially affect the required function.

Different responses of viscoelastic and other foams depending on temperature, body heat, load, body weight and duration of use also do not constitute a guarantee case as long as there is no objectively identifiable loss of a required function of the product.

Changes in personal preferences regarding firmness, softness, temperature or other comfort characteristics are not covered by the guarantee.

6. Cover, Zipper and Normal Wear

The mattress cover and functional zipper are covered by the initial 10-year guarantee.

A material loss of the cover's function to normally enclose, be used on, be removed from or be refitted to the mattress due to a material, manufacturing or workmanship defect will be assessed under the guarantee.

Pilling, superficial textile wear, slight wrinkling, colour changes, normal stretching of the fabric, changes in surface texture and ordinary signs of zipper use resulting from normal use and not materially affecting the required function of the product do not, by themselves, constitute a guarantee case.

7. Damage Excluded from the Guarantee

Improper use or use contrary to the intended purpose; cuts, punctures or burns; unusual mechanical loads; improper folding or alteration of the mattress; intentional damage; liquids or bodily fluids; pets or pests; improper repair or intervention; excessive moisture; improper storage; insufficient ventilation; weather conditions or similar external factors.

Mould or fungal growth is not covered by the guarantee where it is caused by moisture, condensation, insufficient ventilation, improper storage, contamination or other external causes rather than by a defect in the product.

8. Proper Use, Bed Base and Care

The mattress must be used on a bed system that is suitable for its intended purpose, sufficiently stable, flat, dry, adequately ventilated and provides sufficient support across the surface.

Unless a different requirement is expressly specified for the relevant product, the distance between slats in a slatted base system must be less than 4 cm.

The product, care, washing and usage instructions applicable to the mattress and cover at the time of purchase must be observed.

Rather than repeating detailed care procedures in these guarantee terms, the care and usage instructions applicable to the relevant product shall apply.

9. Guarantee Claim and Technical Assessment

For the purposes of assessing a guarantee claim, reasonable evidence of purchase or delivery, order information, a description of the complaint, photographs or videos of the product and the reported condition and, where necessary, information regarding the bed system used may be requested.

This information and documentation is requested solely for the technical assessment of the guarantee claim and does not create a statutory burden of proof to the detriment of the consumer or alter existing statutory rules of evidence.

If a final assessment cannot be made on the basis of the information provided, a physical inspection of the product or the relevant component may be requested.

The assessment process may be suspended until the necessary and reasonable cooperation required to assess the guarantee claim has been provided.

Before the assessment is completed, the product must not be discarded, permanently altered or repaired without authorisation in a manner that prevents identification of the defect or its cause.

10. Remedy Under the Guarantee

In a valid guarantee case, the required standard guarantee service is provided to the consumer free of charge.

Depending on its nature, a defect covered by the guarantee will be remedied by free repair, replacement of the relevant defective component or provision of a suitable replacement product.

Where only a replaceable component is defective and the guaranteed function of the product can be fully restored by repairing or replacing that component, replacement of the entire mattress is not required.

RENABED EUROPE BV bears the standard costs of inspection, transport, labour, materials, repair, replacement and redelivery required for a valid guarantee service.

The standard transport method provided or approved in advance by Scarnatti must be used. More expensive or special transport costs that have not been approved in advance will only be covered to the extent required by mandatory law.

11. Replacement Product and Continuation of the Guarantee Period

If the original product or component is no longer available, an equivalent product or component may be provided in terms of technical function, quality class and intended use.

The replacement product does not have to be identical to the original product in terms of colour, appearance, cover design, material formulation or personal sleeping feel.

Differences resulting from technological or product development are acceptable provided that the replacement product maintains the guaranteed essential function and level of quality.

Repair or replacement does not alter the original start date of the guarantee and does not create a new 101-Night Trial Period unless mandatory law requires otherwise.

If, at the consumer's request, a voluntary option to upgrade to a higher model or larger size is offered, the equivalent standard guarantee remedy remains free of charge and only the price difference notified in advance arising from the voluntarily selected higher-value product may be charged.

Additional Mattress Core Guarantee for Years 11 to 13

12. Activation, Scope and Duration

The original purchaser may activate the additional mattress core guarantee for years 11 to 13 by registering free of charge within 30 days of the mattress's initial delivery.

Registration is required only for this additional guarantee. The initial 10-year durability guarantee covering the entire mattress is not subject to any registration requirement.

If the registration system is unavailable for technical reasons, registration may be completed within the same period by email to customer-help@scarnatti.com.

The additional guarantee covers only the mattress core.

The cover, zipper and other textile components are not covered by the additional guarantee for years 11 to 13.

The additional guarantee covers material, manufacturing or structural defects in the core and permanent structural changes that materially affect its essential function for its intended use.

The provisions in Sections 5, 7, 8 and 9 concerning normal material changes, use, care, external factors and assessment apply correspondingly to the additional guarantee.

In a valid case under the additional guarantee, the mattress core will be repaired free of charge or replaced with a suitable equivalent core. If this is not technically appropriate, another equivalent solution may be provided.

The additional guarantee begins after expiry of the 10-year commercial durability guarantee and ends at the end of the 13th year from the original delivery date.

Repair or replacement does not start a new guarantee period.

This additional guarantee is not an extension of the 10-year GARAN durability guarantee, does not constitute a 13-year guarantee for the entire mattress and does not alter the guarantee period stated on the GARAN label.

13. Additional Provisions

Under this commercial guarantee, the guarantor's primary obligation is to remedy a defect covered by the guarantee by means of free repair or suitable replacement.

The consumer's statutory rights against the seller to repair, replacement, price reduction, termination of the contract, compensation, product liability and other mandatory statutory rights remain unaffected.

If any provision of these guarantee terms is invalid, this does not affect the validity of the remaining valid provisions or the consumer's mandatory statutory rights.

This guarantee is governed by German law; mandatory consumer protection provisions applicable for the benefit of the consumer remain unaffected.

The guarantee statement applicable at the time of purchase shall apply to the relevant product. Subsequent changes may not retroactively alter guarantee rights that have already arisen to the detriment of the consumer.
